Your privacy is important to us. This Privacy Policy (“Policy”) applies to services provided by Real Simple Labs, Inc. (“we”, “us”, or “Company”) and our website, product pages, mobile or web applications, or other digital products that link to or reference this Policy (collectively, the “Services”) and explains what information we collect from users of our Services (a “user”, “you”, or “your”), including information that may be used to personally identify you (“Personal Information”) and how we use it. We encourage you to read the details below. This Policy applies to any visitor to or user of our Services.

We reserve the right to change this Policy at any time. We will notify you of any changes to this Policy by posting a new Policy to this page, and/or by sending notice to the primary email address specified in your account. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically reviewing this Policy to check for any changes. Changes to this Policy are effective when they are posted on this page. You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Policy means that the collection, use and sharing of your Personal Information is subject to the updated Policy.

Scope and Applicability

The Policy applies to your information collected by us as the data controller through your use of the Services. In some instances, we have contractually committed ourselves to only process certain information on behalf of and under the instruction of the respective merchant from whom you make a purchase, and who is the data controller. In those limited instances, we act as the “data processor” and this Policy does not apply to such processing.

Moreover, this Policy does not apply to any third-party applications or services that are used in connection with our Services, or any other products, services or accounts provided by other entities under their own terms of service and privacy policy (collectively, "Third-Party Services"). These Third-Party Services are not part of our Services and are provided by independent third parties under their policies and terms. Lastly, the Services may contain links to other websites. We have no control over these websites and they are subject to their own terms of use and privacy policies.

What Information Do We Collect?

Information You Provide to Us

Account Information: To create an account for the Services or to enable certain features, you will be required to provide us with your phone number, and you may also be asked to provide your name, profile picture, email, shipping address, billing address, and other information provided to us through Shopify to perform the checkout.

Financial Information: When you create your account, we ask you to connect your U.S. state or federally chartered bank account or debit card (“Payment Method”) to your account, which is then used to make a purchase through one of our authorized merchants.

Bank Account Information: When you choose to make a purchase by linking your bank account, we use a third-party bank account verification provider, such as Plaid Inc. (“Plaid”) or Stripe, Inc. (“Stripe”), to connect your SimplePay account with your bank account, verify your bank account, and confirm your bank account balance prior to approving a transaction with one of the authorized merchants. We do not receive your bank account number directly. The financial information requested is shared directly with the third-party bank account verification provider, and is processed by the third-party bank account verification provider in accordance with their respective Privacy Policy. In some instances, the data submitted to the bank account verification provider will be passed to a third-party payment processor in order to complete your purchase.

For example, in some instances, we use Plaid as our third party payment processor. Plaid’s use of your personal information is governed by their privacy policy, which is available here: https://plaid.com/legal/#end-user-privacy-policy. Stripe’s privacy policy is available at https://stripe.com/privacy. If you are asked to manually verify your bank account information, for instance if third-party verification provider is not able to connect to your bank account directly, they may place a micro-deposit (usually up to $1) in your account in order to verify your account. Once verified, the micro-deposit will be removed/deducted from your account (this typically happens within a few days).

Debit or Credit Card Information: When you choose to make a purchase by linking your debit card, we use a third-party provider to process your payments. In other limited instances, you may be able to make a purchase with one of our authorized merchants using your credit or debit card information, for example, if we are unable to link your bank account during the checkout process with one of the authorized merchants. In these instances, we will either use our third-party payment processor. Because these payments are made to a third-party payment processor, we do not retain any personally identifiable financial information such as credit card numbers. Rather, all such information is provided directly to our third-party payment processor, or, where your purchase is made directly with the authorized merchant, to the merchant’s third-party processor as if you’d paid with your credit card on the merchant’s site. The payment processor’s use of your personal information is governed by their privacy notice. Please review each processor’s privacy notice to understand how they will manage or otherwise process your personal information, including your financial data.

Business Contact Information: If you are a business representative, we collect your information in connection with the performance of the agreement or potential agreement with us. This information may include your first name, last name, company contact information (e.g., email, phone, address), job title, and any other information related to the performance of the agreement with us.

Other Information You Provide: We receive other information from you when you choose to interact with us in other ways, such as if you sign up for one of our webinars or newsletters, participate in a research study or event, or otherwise communicate with us.

Information We Collect Automatically

Furthermore, we may automatically collect in and through the Services the following “Technical Information”:

Device Data, including information about the type of device or browser you use, your device's operating software and settings, your internet service provider, and device identifiers, such as IP address and advertising identifier.

Usage Data, including, but not limited to, search terms entered, pages viewed, and other usage behavior identified by analytics events.

Location Data, including approximate geographic location derived from your IP address or business information.

Network and internet information, including, URLs, Internet Protocol addresses, bounce rates, use of spoofing, active (TCP/IP) ports, number of sessions initiated, click streams, location information and network/Wi-Fi access points.

We use cookies and other tracking technologies to help us collect and process Technical Information. Please see the “How Do We Use Tracking Technologies” section below for more information.

Information We Receive from Third Parties

Information from Authorized Merchant(s). When you make a purchase with one of our authorized merchants using the SimplePay checkout payment option, we may receive certain transactional information in connection with your purchase, including your name, email address, phone number the order ID tied to a specific transaction, timestamp, amount of purchase, items purchased (e.g., name, image and SKU), shipping and billing addresses, delivery information, and the store credit(s) you have earned from the merchant and related credit information in connection with the purchase. In some instances, we may also receive the support conversations between you and the merchant, as well as your prior transaction history with the merchant. We use this information to provide our Services, mainly to manage the store credits you have received from each of your purchases through one of our authorized merchants.

Information from Third-Party Bank Account Verification Providers. We may also receive the  following information related to your account from our third party bank account verification providers: bank name, account name, account holder name, email address, phone number, billing address, account number mask, account type, and account balance at the time of the purchase. We use this information to provide the Services and process your payment, as well as for our internal business purposes, such as security and fraud prevention.

Social Media. When you interact with our Services through various social media, such as when you click on the social media icon on the Service, follow us on a social media site, or post a comment to one of our pages, we may receive information from the social network such as your profile information, profile picture, gender, user name, user ID associated with your social media account, age range, language, country, and any other information you permit the social network to share with third parties. The data we receive may be dependent upon your privacy settings with the social network. We use this information to operate, maintain, and provide to you the features and functionality of the Services, as well as to communicate directly with you, such as to send you email messages about products and services that may be of interest to you.

Service Providers. Our service providers that perform services on our behalf collect personal information and often share some or all of this information with us, which helps us operate our business.

Your Employer/Company. If you interact with our Services through your employer or company, we may receive information from your employer or company, including another representative of your employer or company.

Joint Marketing, Business Partnership, Referrals, and Rewards Partners. We may receive information from our partners that we engage for joint marketing activities and our referrals and rewards programs.

Information from Other Sources. We may obtain information from other sources, including, but not limited to, publicly available sources, third-party data providers, brand partnerships, and third-party integrations you consent to, or through transactions such as mergers and acquisitions. We may combine this information with other information we collect from or about you.

How Do We Use The Information We Collect?

We use the information we collect:

To deliver and improve the Services and your overall user experience.

To protect, investigate, and deter against fraudulent, unauthorized, or illegal activity.

To link or combine user information with other Personal Information.

To develop, improve or expand our business, products and services.

To conduct internal reporting, auditing, and research, including focus groups and surveys.

To compare and verify information for accuracy and update our records.

To email, message, or otherwise contact you with information and updates about us and the Services.

To respond to your comments and questions and provide customer service.

To send you information including confirmations, invoices, technical notices, updates, security alerts, and support and administrative messages.

For marketing and advertising purposes, such as to market to you or offer you through email, social media, or text message, information and updates on our products or services we think that you may be interested in.

For analytics and research purposes.

To administer, identify and facilitate potential product improvements or future product developments (including training and refining automated tools leveraging AI).

In connection with a merger, acquisition, reorganization or similar transaction.

When required by law or to respond to legal process.

To protect our users, other individual lives, and/or the rights or property of Company.

To maintain the security of the Services.

At your direction or instruction, or for any other purpose with your consent.

Do We Share Your Personal Information?

In addition to the specific situations discussed elsewhere in this privacy policy, we disclose personal information in the following circumstances:

With our authorized merchants: We may disclose personal information with our authorized merchants for transactional and marketing purposes, including to promote their products or services.  For example, we may share information with a merchant you have previously made a purchase from such as information about the owner of the credit and information about the credit, such as name, email address, phone number, credit amount, credit expiration date, and date the credit was issued. The authorized merchants’ use of your personal information is governed by their respective privacy notice.

With our corporate affiliates and subsidiaries.

[With other Members of the Service With Whom You Share Your Store Credits or Refer to the Service: When you share your store credits with others, the recipient of the store credit will be able to see your first name in their store credit transaction activity page (e.g. the activity will show as “claimed store credit from Jane D.” or something similar). Similarly, once your gifted store credit is claimed, your store credit transaction activity page will reflect the first name and first initial of the last name of the individual who claimed the gifted store credit. Please note this information will only be visible to the account holder as part of the store credit account activity, and will not be visible to any third parties. If you are referred by an existing SimplePay user and make your first purchase through the Service, Catch will notify the individual who referred you and share your first name and first initial of your last name with that individual].

With third parties that perform services to support our core business functions and internal operations, which may include database administrators, cloud computing services, payment processors, advertising services, and application services providers.

With third parties that we have partnered with, such as to  jointly create and offer a product, service or joint promotion or in connection with facilitating referral partnerships.

To support our audit, compliance, and corporate governance functions.

In connection with a change of ownership or control of all or part of our business (such as a merger, acquisition, reorganization, or bankruptcy).

If we have a good-faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to detect or protect against fraud or security issues.

If required or permitted by applicable law or regulation, including laws and regulations of the United States and other countries, or in the good faith belief that such action is necessary to: (a) comply with a legal obligation or in response to a request from law enforcement or other public authorities wherever Company may do business; (b) protect and defend the rights or property of Company; (c) act in urgent circumstances to protect the personal safety of users, customers, and contractors/employees of Company or others; or (d) enforce our Terms of Service or otherwise protect against any legal liability.

With your consent or at your direction.

How Do We Use Tracking Technologies?

Some of the features on the Services may require the use of “cookies” - small text files that are stored on your device’s hard drive. We use Cookies to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, to remember your preferences, analyze trends, learn about our user base, provide relevant advertising, and operate and improve our Services. We may supplement the information we collect from you with information received from third parties, including information collected using third party cookies. You may delete and block all cookies from our Services, but parts of the Services may not work or your overall user experience may be diminished, since it will no longer be personalized to you. It may also prevent you from saving customized settings, like log-in information.

Session replay technologies, such as FullStory, Inc., may be used to collect information regarding visitor behavior on the Service. You can opt out of FullStory’s collection and Processing of data generated by your use of the Services by going to https://www.fullstory.com/optout/.

How Do We Secure Your Personal Information?

We take reasonable steps to protect your Personal Information against unauthorized access, alteration, disclosure, misuse, or destruction. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure.  The safety and security of your Personal Information also depends on you. If you have an account with us, you are responsible for keeping your membership details confidential. Your account is protected by your account password and we urge you to take steps to keep your Personal Information safe by not disclosing your password and by logging out of your account after each use. We further protect your Personal Information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology. However, these measures do not guarantee that your Personal Information will not be accessed, disclosed, altered or destroyed by breach of such firewalls and secure server software. By using the Services, you acknowledge that you understand and agree to assume these risks.

Data Retention

We retain your Personal Information while your account is in existence or as needed to provide the Services to you. This includes data you or others provided to us and data generated or inferred from your use of the Services. Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law. We may retain an archived copy of your records as required by law or for legitimate business purposes.

Managing Your Privacy

All users may request to review, update, or correct the Personal Information furnished by a user in their user account by accessing your user account. To delete your account or other personal information, please contact us at support@realsimplelabs.com. For your protection, we may only share and update the Personal Information associated with the specific email address that you use to send us your request, and we may need to verify your identity before doing so. We will try to comply with such requests in a reasonably timely manner. If you completely and permanently delete all of your Personal Information, then your user account may become deactivated. Please note that we may retain information that is otherwise deleted in anonymized and aggregated form, in archived or backup copies as required pursuant to records retention obligations, or otherwise as required by law. We may retain an archived copy of your records as required by law or for legitimate business purposes.

We may use some of the information we collect for marketing purposes, including to send you promotional communications about new Company features, products, events, or other opportunities. If you wish to stop receiving these communications or to opt out of use of your information for these purposes, please follow the opt-out instructions, such as clicking "Unsubscribe" (or similar opt-out language) in those communications. For text message communications, you can text back “STOP” and we will send you a text message to confirm that you have been unsubscribed. You can also contact us at support@realsimplelabs.com to opt out. Despite your indicated email preferences, we may send you service related communications, including notices of any updates to our terms of service or privacy policy.

How We Respond to Do Not Track Signals

Your browser settings may allow you to automatically transmit a Do Not Track signal to websites and other online services you visit. We do not alter our practices when we receive a Do Not Track signal from a visitor’s browser because we do not track our visitors to provide targeted advertising. Children Under 16

The Services are not directed to individuals who are under age of sixteen (16) and we do not solicit nor knowingly collect Personal Information from children under the age of sixteen (16). If you believe that we have unknowingly collected any Personal Information from someone under the age of sixteen (16), please contact us immediately at support@realsimplelabs.com and the information will be deleted.

Region-Specific Disclosures

A Note to California Residents

We currently do not share Personal Information with third parties for their direct marketing purposes, as contemplated by California Civil Code Section 1798.83, without your consent.

A Note to Nevada Residents

If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Information to third parties who intend to license or sell that Personal Information. You can exercise this right by contacting us support@realsimplelabs.com with the subject line “Nevada Do Not Sell Request” and providing us with your name and the email address associated with your account. Please note that we do not currently sell your Personal Information as sales are defined in Nevada Revised Statutes Chapter 603A.

A Note to Users Outside the United States

Our Company is based in the United States. The Services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the laws of the country(ies) where the Services are controlled. Your Personal Information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the [United States], which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Information.
